and have attached it. We welcome your suggestions or comments.

Supplier Integrity Guide page 4, bullet starting, ÒPermitting any discharge to the environment..Ó :
As professional engineers we may be auditing your or your customers
environmental discharges and be the first to know of a violation. We will keep this data confidential
according to the process data requirements of your document P28A-AL-003 Rev D
paragraph 18 and our ÒProtecting Client DataÓ policy unless there is a life
safety issue. We believe your bulleted item most likely only refers to the operation
to our and our supplier facilities in which case this needs to be clarified in
writing per paragraph 1 of P28A-AL-003 Rev D.

Supplier Integrity Guide page 5, bullet starting, ÒOnly transmit GE
informationÉÉÉencryptedÓ : For secure email communications, Clean Air uses
PGP encryption (a Network Associates / McAfee product) typically set to the
standard 2048 bit Diffie-Hellman encryption (presently the most widely used
email encryption method). Other
encryption methods and strengths are acceptable if required by GE Energy
Services. Do you want us to encrypt all email or just documents containing
confidential information such as emissions and process data?

GE Power Systems
Document P28A-AL-0003 Rev D, Section 2: We donÕt offer products or services on
a 1.5% - 15 day terms to any other company and therefore we will define all
such purchases as different form those offered to other Parties. All such products or services purchased
in this manner will be defined as different and the last two sentences of this
section will not apply in the spirit of the 2nd bullet of the GE
Code of Conduct.

Document P28A-AL-0003 Rev D Section 9: Strike Òfound to be defectiveÓ
and replace with Ò unsatisfactory for any reason Ó.

GE Power Systems Document
P28A-AL-0003 Rev D, Section 4 and Section 18: CleanAir maintains a secure data
vault which holds copies of all our raw data, related process data and reports
for the last 30 years. This enables us to provide our customers with historic
data after many years and provide evidence of our quality in the unlikely event
of a challenge. Therefore Section 18 shall not be read such to require all
copies of our work product be sent to Buyer unless mutually agreed to have a
copy held by an escrow agent at BuyerÕs expense or unless Buyer agrees to
defend and hold us harmless any future challenge to the related work.
G.
GE Power Systems
Document P28A-AL-0003 Rev D Section 25:
We find the first sentence of this section to be contrary to the spirit
of GE Code of Conduct bullet 2.
Specifically we wouldnÕt want to agree to some unknown future request
which could be contrary to our Code of Conduct. In addition we do not wish to
participate in an reverse auction for our products or services since we strive
to be the highest total value not the lowest price.
As
owners of GE stock we think that both documents could be improved to accomplish
the desired objectives without making enemies and loosing customers. We want all those who read these to
feel good about GE and not go home and throw out all their GE appliances. Lawyers and accountants shouldnÕt be
the only ones with input into your Terms and Conditions. We would be honored to participate in a
customer focus group on this.
